Tigerlily Training App - Terms and Conditions of Use

1. Introduction

These terms and conditions ("Terms") govern your use of the Tigerlily Training mobile application ("App") developed and operated by Tigerlily Training Ltd  ("Tigerlily Training"). By downloading, installing, or using the App, you agree to be bound by these Terms.

2. Licence

Subject to your compliance with these Terms, Tigerlily Training grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use only.

3. User Content

The App may allow you to submit or upload content, such as comments, reviews, photos, or videos ("User Content"). By submitting or uploading User Content, you grant Tigerlily Training a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content worldwide in any media.

You represent and warrant that you own or have the necessary licences, rights,
consents, and permissions to submit or upload User Content, and that such User
Content does not infringe or violate the intellectual property or other rights of any third party, or any applicable law or regulation.

4. Prohibited Conduct

You agree not to:

4.1. use the App for any illegal or unauthorised purpose;
4.2. interfere with or disrupt the App or servers or networks connected to the App;
4.3. harass, abuse, or harm another person;
4.4. use the App to collect or store personal data about other users;
4.5. impersonate any person or entity, or falsely state or otherwise misrepresent
yourself or your affiliation with any person or entity;
4.6. use any automated system, software, or means to access, scrape, or crawl the
App or its content.

5. Intellectual Property

The App and its content, including but not limited to text, graphics, logos, images, and software, are owned by or licensed to Tigerlily Training and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any of the App's content without Tigerlily Training's prior written consent.

6. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of
merchantability, fitness for a particular purpose, or non-infringement. Tigerlily
Training does not warrant that the App will be uninterrupted or error-free, nor does it make any representations or warranties about the accuracy, completeness, or reliability of any information, content, materials, or services provided through the App.

7. Limitation of Liability

To the fullest extent permitted by law, Tigerlily Training shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the App, whether based on contract, tort, strict liability, or any other legal theory, even if Tigerlily Training has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold harmless Tigerlily Training and its affiliates, officers, directors, employees, and agents from any and all claims, damages, expenses, or losses arising out of or in connection with your use of the App or your User Content.

9. Termination

Tigerlily Training reserves the right to suspend or terminate your access to the App at any time, without notice or liability, for any reason whatsoever.

10. Governing Law

 be governed by and construed in accordance with the laws of England, without regard to its conflict of law provisions.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the The Arbitration Act 1996 in England, and judgement upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof

12. Changes to Terms

Tigerlily Training may modify these Terms at any time, in its sole discretion, by
posting the modified Terms on the App or providing notice to you. Your continued use of the App after the effective date of any such modification constitutes your acceptance of the modified Terms.

13. Miscellaneous

These Terms constitute the entire agreement between you and Tigerlily Training
regarding the use of the App, and supersede all prior or contemporaneous
agreements or communications, whether written or oral. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Tigerlily Training's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. You may not assign these Terms, in whole or in part, without Tigerlily Training's prior written consent. Tigerlily Training may assign these Terms without your consent or any notice to you.
